Terms of service
Last updated 30 September 2026. These terms apply to every quote, project and monthly plan provided by Tech Bintang LLC.
1. The parties and these terms
"We", "us" or "Tech Bintang" means Tech Bintang LLC, a Texas limited liability company, 5900 Balcones Drive, Ste 23734, Austin, TX 78731, United States. "You" means the person or business that requests a quote, accepts a proposal, pays an invoice or subscribes to a plan. By doing any of those you agree to these terms. A written proposal may add project-specific terms; where the two differ, the proposal wins.
2. Proposals, scope and changes
Every project starts with a written proposal that lists what is included, the price, the delivery date and the payment schedule. A proposal is valid for 14 days. Work starts when you accept it in writing (email is enough) and the first payment has cleared. Anything not listed in the proposal is out of scope; if you ask for it we quote it as a change request, and we only do it after your written approval. Changes can move the delivery date.
3. Prices, taxes and third-party costs
Prices are in US dollars. They do not include third-party costs — hosting, domains, platform subscriptions, plugins, app-store fees, paid tools or ad spend — which you pay directly to the provider, nor any sales tax, VAT or bank and transfer fees, which are added where they apply. Published prices can change at any time; the price in your accepted proposal does not.
4. The beat-any-quote guarantee
If, before accepting our proposal, you send us a written, dated quote (no older than 30 days) from a registered business for materially the same scope, we will price the work 10% below it. We decide whether the scope is materially the same and may ask to verify the quote. The guarantee does not apply to quotes below our cost of delivery, to freelancer marketplace bids, to work already started, or together with any other discount. If we decline, we tell you before you commit.
5. Payment
One-time projects: 50% deposit on acceptance and 50% on delivery, or the milestone schedule in the proposal. The deposit reserves our team's time and is non-refundable once work has started. Monthly plans are billed in advance for each period. Invoices are due within 7 days. Late amounts carry a late fee of 1.5% per month (or the highest rate allowed by law, if lower), and you pay reasonable costs of collecting overdue amounts. We may pause work, withhold deliverables and suspend services we host or manage while an invoice is overdue. Nothing delivered may be used in production until the related invoice is paid in full.
6. Chargebacks and disputes about invoices
If you disagree with an invoice, tell us in writing within 7 days and we will work it out with you. Opening a card chargeback or payment dispute without first contacting us is a breach of these terms; for undisputed work you remain liable for the amount, any chargeback fees and our costs, and your licence to use the deliverables is suspended until it is resolved.
7. Your responsibilities
You provide content, logins, feedback and approvals within a reasonable time, and you confirm you own or have permission to use everything you give us (text, images, logos, data). Your delays extend the delivery date by at least the same period. If a project waits on you for 30 days it is paused; after 60 days we may treat it as complete and invoice the remaining balance for the work done. You are responsible for the legality of your business, products, prices, advertising claims and the privacy policy and cookie consent on your own website or app.
8. Revisions, acceptance and support
Each package includes the revision rounds stated in the proposal; more rounds are quoted separately. A deliverable is accepted when you approve it in writing, start using it publicly, or 7 days after delivery if we receive no written list of defects. We fix bugs in our own work during the support period stated in your package. New features, content changes, third-party updates and problems caused by other people's changes are not bugs and are quoted separately.
9. Ownership and licences
When you have paid in full, you own the deliverables made for you — source code, designs, content and assets — and every account we set up (hosting, domains, ad accounts, app-store listings) is in your name. Until then we keep ownership and you may use the work only to review it. We keep our pre-existing tools, code libraries, templates and know-how and give you a permanent licence to use them as part of your deliverables. Third-party and open-source components stay under their own licences. Unless you ask us not to in writing, we may show the finished work and your name or logo in our portfolio, without disclosing confidential information.
10. Monthly plans and cancellation
Monthly plans (social media, SEO and retainers) run month to month with no minimum term unless your proposal says otherwise. Cancel by email at least 7 days before the next billing date. Fees for the current period are not refundable and work already delivered stays yours. We may end a plan with 30 days' notice, or immediately for non-payment, abuse or misuse.
11. No guaranteed results
We commit to doing the work described in your proposal to a professional standard. We do not guarantee rankings, traffic, followers, leads, sales, ad performance, app-store approval or any decision made by Google, Meta, Apple, Shopify or other platforms, whose rules and algorithms we do not control and which can change at any time. Estimates and examples we give are not promises. Reports show the work done and what was measured.
12. Platforms, accounts and security
You are responsible for keeping your passwords safe, for the accounts in your name and for their billing. We are not liable for suspensions, policy decisions, price changes, outages or data loss caused by third-party platforms or hosting providers. Unless a hosting or maintenance plan says otherwise, you are responsible for keeping backups.
13. AI tools and communications
We may use AI-assisted tools (for example to draft copy, summarise enquiries or answer first questions in the chat, on WhatsApp or by phone); a person reviews everything before it is delivered to you as work. If you give us a phone or WhatsApp number and agree to be contacted, you agree that we may call or message you about your enquiry and project, including with automated or AI-assisted calls and messages. Calls may be recorded and transcribed so we get your details right. You can stop any channel at any time by replying STOP, clicking unsubscribe or telling us.
14. Confidentiality
Each of us keeps the other's non-public information confidential and uses it only for the project. We sign a mutual NDA on request before you share anything sensitive. This does not cover information that is public, already known, or that must be disclosed by law.
15. Limitation of liability
To the fullest extent permitted by law: (a) our total liability for all claims relating to a project or plan is limited to the fees you paid us for that project, or for the three months of the plan before the claim arose; (b) we are not liable for indirect, incidental or consequential loss, lost profits, lost revenue, lost data or business interruption; and (c) apart from what these terms and your proposal say, the services are provided without other warranties, express or implied. Nothing here limits liability that cannot be limited by law.
16. Indemnity
You will defend and compensate us against claims, losses and reasonable legal costs arising from material you gave us, your products or services, your advertising and marketing claims, your instructions to us, or your breach of these terms or of the law.
17. Non-solicitation
During a project and for 12 months after it, you agree not to hire or engage directly any person who worked on your project through us without our written consent.
18. Ending a project
Either of us may end a project by written notice if the other seriously breaches these terms and does not fix it within 10 days. If a project ends early for any reason other than our breach, you pay for all work done up to that date (the deposit is kept) and any costs we cannot cancel. Sections on payment, ownership, confidentiality, liability, indemnity and disputes continue after a project ends.
19. Events outside anyone's control
Neither of us is liable for delays caused by events beyond reasonable control, such as outages of internet, hosting or platform providers, natural disasters, war, government action or illness; deadlines move by the length of the delay.
20. Disputes and governing law
These terms are governed by the laws of the State of Texas, United States. We both agree to try to resolve any dispute by good-faith discussion for 30 days first. If that fails, the dispute will be settled by confidential binding arbitration in Travis County, Texas, under the Commercial Arbitration Rules of the American Arbitration Association, except that either of us may bring a claim in small-claims court or ask a court for urgent relief to protect confidential information or intellectual property. Claims are brought individually, not as part of a class. Where the law of your country gives you rights that cannot be waived, those rights still apply.
21. General
These terms and your proposal are the whole agreement between us about the project. If any part is found unenforceable, the rest still applies. We may update these terms; changes apply to proposals accepted and plan periods starting after the update. You may not transfer the agreement without our written consent. Notices are given by email to the addresses used for the project.
